• What is eRecording?
  eRecording refers to the electronic delivery of real property/real estate documents (such as deeds, mortgages, deeds of trust, liens, assignments, satisfactions, affidavits, etc.) to and from the appropriate county/jurisdiction recording office for filing in public records. By eRecording, both document submitters and document recorders are liberated from the burden and risk of handling paper documents.
  
  
• What is a document submitter?
  A document submitter is any entity responsible for having documents filed in public records. Often times, a document submitter will also be said its creator. Common document submitters include, but are not limited to, title companies, attorneys, lenders, loan servicers and construction firms.
  
  
• What are real property documents?
  First, let us define the term "real property". Real property, also known as real estate, is any subset of land that has been legally defined along with the improvements made to it by human efforts (house, building, machinery, well, dam, pond, mine, canal, road, etc.). Therefore, a real property document is any legal document which may affect title to one or more parcels of real property. Examples include, but are not limited to, deeds, mortgages, deeds of trust, liens, assignments, satisfactions, affidavits and many, many more.
  
  
• Is eRecording legal and widely accepted?
  Yes. Legislation has passed at both federal and state levels allowing for the secure implementation of eRecording. On June 30, 2001, the Electronic Signatures in Global and National Commerce Act (ESIGN) was enacted by the U.S. Congress. Additionally, almost all states have adopted a form of the Uniform Electronic Transaction Act (UETA) and/or the Uniform Real Property Electronic Recording Act (URPERA). Additionally, many major underwriters and lenders actively promote eRecording in order to lower costs, increase customer service levels, and mitigate risk exposure.
  
  
• What happens to my original "paper" document?
  When eRecording, a digital image of your document is recorded in public records.   e-Docs Solutions uses Automated Clearing House (ACH) to debit a document submitter's bank account. ACH is a secure electronic network for financial transactions used by the Federal Reserve banks. This means that document submitter no longer have to worry about issuing, tracking and matching paper checks; instead, funds are automatically debited from a designated bank account.
  
  
• What will my recorded document image look like?
  Documents recorded electronically will look very similar to their paper counterparts. Recording information will be "stamped" onto the document image, as is done with paper documents. Upon recording, the recorded document image is forwarded to the document submitter.
  
  
• Can I pay for recording fees using a credit card?
  No. At this time, the only accepted form of payment is ACH (Automated Clearing House).
  
  
• Is eRecording safe?
  Yes. All data transmitted is encrypted and tamper-proof sealed.
  
  
• Doesn't eRecording raise the risk of fraudulent documents being filed?
  No, it does not. In fact, many would argue that eRecording actually reduces the likelyhood of fraudulent documents from being filed in public records. Think about it for a moment: how safe are paper documents?
